Особливості забезпечення охорони правопорядку на деокупованих територіях

Abstract

Визначено особливості адміністративно-правового забезпечення охорони правопорядку на деокупованих територіях. Розглянуто поняття деокупованих територій і акцентовано, шо окуповані території варто поділяти на декілька груп, відповідно до кожної планувати або визначати чи коригувати діяльність органів державної влади України з відновлення українського суверенітету на них – такий підхід зазначати у нормативних документах стратегічного характеру або в планах дій правоохоронних органів на таких територіях; основним критерієм класифікації при цьому є час перебування таких територій під окупацією. Проаналізовано нормативно-правові документи, що визначають головні заходи на деокупованих територіях для правоохоронних органів, на основі яких розкрито особливості адміністративно-правового забезпечення охорони правопорядку на таких територіях The article deals with the definition of the features of administrative and legal support for the protection of law and order in the de-occupied territories. The concept of de-occupied territories is considered and it is noted that the occupied territories should be divided into several groups, in accordance with each of which the activities of the state authorities of Ukraine to restore Ukrainian sovereignty in them should be planned or determined or adjusted, and such an approach should be indicated in regulatory documents of a strategic nature or in action plans of law enforcement agencies in such territories, and the main criterion for classification is the time of such territories being under occupation. The regulatory and legal documents that determine the main measures in the de-occupied territories for law enforcement agencies are considered, on the basis of which the features of the administrative and legal support for the protection of law and order in such territories are discussed. It is concluded that law enforcement agencies perform tasks that are not typical for peacetime in the de-occupied territories, among which the detection and documentation of the facts of the use of russian symbols of aggression against Ukraine, the implementation of measures to demine the territories of settlements; implementation of measures to identify persons involved in collaborative activities and aiding the aggressor state; this is the restoration of registers on weapons and the acceptance, storage of seized, voluntarily surrendered or found weapons, explosives that remain after active hostilities and are weapons of the regular army, that is, those that do not fall into the hands of the population in peacetime; verification of the legality of the stay on the territory of Ukraine of citizens of the aggressor state is also an atypical task for law enforcement agencies in ensuring law and order; a feature is also the documentation of war crimes committed by russians and keeping records of violations of the rights and freedoms of the civilian population as a result of the armed aggression of the russian Federation against Ukraine in accordance with national law
