Характеристика адміністративно-правової діяльності поліції у сфері обігу спеціальних засобів самооборони в Україні

Abstract

Висвітлено адміністративно-правову діяльність поліції з регулювання обігу зброї та безпосередньо спеціальних засобів самооборони в Україні, висвітлено шляхи удосконалення вищезазначеної діяльності. Виокремлено особливості певних різновидів адміністративно-правової діяльності поліції у сфері обігу зброї в Україні.

The formation of Ukraine as a rule of law is associated with the constant increase in the efficiency of state bodies' activities, which is aimed at ensuring sustainable development of society, as well as the detection, prevention and neutralization of real and potential threats to state and national interests in all spheres of public life. The urgent issue is ensuring the proper level of public (public) order and security of the state, which would meet the requirements of the present. An important role in providing public (public) order and security is provided by the police, the tasks of which are aimed at protecting national interests, rights and interests of citizens and business entities. It is impossible not to mention the fact that one of the components of activity in the above-mentioned direction is permitting activity, including in the sphere of special funds circulation, as the above-mentioned special means of self-defense are one of the most common objects of the permit system. In this regard, the purpose of this article is to determine the features and characteristics of the administrative and legal activities of the police in the field of the circulation of special means of self-defense and ways to improve it. To achieve this goal, the following main tasks are expected to be addressed: 1) to examine the meaning of the term "administrative activity"; 2) characterize the administrative and legal activities of the police in the sphere of the circulation of special means of self-defense; 3) suggest ways to further improve such activities. In the process of implementing the tasks assigned to the police, various means and methods of influencing public relations that are formed in the sphere of the circulation of special means of self-defense are used in order to streamline them. Among this aggregate of funds, prominent place occupy administrative and legal means. And the activities within which the implementation of administrative and legal means is called administrative. In conducting an analysis of legal literature and current legislation in order to identify the concept of administrative activity and its features causes some difficulties, because the term "administrative activity" in the current legislation, the term is not used, but in modern scientific literature is used in meaning but has certain differences, and also quite often is identified with the term "public administration". Accordingly, it is necessary to study the issue of isolation by identifying certain features, such as the administrative and legal activity of the police as a whole, and in the sphere of the circulation of special means of self-defense. By defining these characteristics and providing them with characteristics, it will probably be possible to propose some ways to improve the administrative and legal activities of the police in the sphere of the circulation of special means of self-defense.
