Abstract

Розглянуто нормативно-правові акти, що регламентують підстави та порядок огляду водіїв транспортних засобів на стан алкогольного, наркотичного чи іншого сп'яніння або перебування під впливом лікарських препаратів, що знижують увагу та швидкість реакції; виявлено недоліки правозастосовної практики в цій сфері та надано пропозиції щодо її вдосконалення.

Considered regulations governing the grounds and procedure for inspection of drivers in the state of alcoholic, narcotic or other intoxication or being under the influence of drugs that reduce the attention and speed of reaction, which include the Code of Ukraine on Administrative Offences (Article 266 ) and subordinate regulations. Having examined the legal basis and the procedure for examination of drivers in the state of alcoholic, narcotic or other intoxication or being under the influence of drugs that reduce the attention and speed of reaction, provided suggestions for improvement, namely the introduction of specially equipped mobile stations (cars) owned health facilities and meet the requirements set by the Ministry of health as required by law or by changes to the referral drivers for the review to identify the influence of alcohol, drugs or other intoxication or being under the influence of drugs that reduce the attention and speed of reaction, and conduct such a review.
